## OREGON PAID FAMILY AND MEDICAL LEAVE

### Oregon Paid Family and Medical Leave Program

# All Oregon businesses with one or more employees are required to offer the new paid medical and family leave starting January 1, 2023. Employers who do nothing will automatically be enrolled in the state based plan. Conversely, the state has also given employers the option of providing the same benefits or better through private insurance.

- January 1, 2023 MetLife equivalent plan is exempt from paying PFML taxes
- September 3, 2022 employees can start applying for benefits & premium payments start
- MetLife Plan Rate = 0.87% of employees wages

* The state will collect the contribution's quarterly basis in arrears. Private plan contributions can be aligned to billing frequency of other charges.

* State Plan Rate = 1% of employee wages

* MetLife Private Insurance is available to Employers with 100 or less Employees

* MetLife PFML Plan must be packaged with MetLife Dental or Disability plan.

* For employers with less than 25 lives using the state program, if they pay their portion of the contribution, they are eligible to receive assistance grants. Grants not applicable to private plan.

***Is my business required to offer PFML benefits to employees?***+

*Yes. Currently, private employers that employ one or more individuals are required to offer the new paid family and medical leave. Those who are self-employed or are sole proprietors are also eligible to opt-in to the program.*

***Is my business required to use the state-run paid leave program?***+

*No, while private employers with one or more employee are required to offer PFML, they may choose to apply for an exemption through the Employment Department if they want to offer the same benefits or better to all employees through private insurance or a self-funded program.*

***How is the program funded?***+

*The state-run program has a shared payroll-based contribution of no more than 1% of an employee’s wages to fund the program. The final rate is expected in the summer of 2022.  
• Employees will pay 60% of the contributions.  
• Employers with more than 25 employees will pay up to 40%.  
• Employers with less than 25 employees are not required to submit their employer portion.*

***How do you calculate PFML contribution amounts due for each employee?***+

 Wages x 60% = PFML employee payroll deduction for the 2023 calendar year. The illustrative table above shows an example if the rate is 1%.
